Privacy Policy

What we collect, why we collect it, and who we give it to. This site sets no cookies and runs no tracking.

1. Who we are

This site is operated by The Black Stuff (Australia) Pty Ltd (ABN 56 087 365 893) of 833 Topaz Road, Glen Allyn QLD 4885 (we, us, our). Copyright in the site and its contents is owned by The Black Stuff Pty Ltd, a member of the same group of companies.

This policy explains what personal information we collect, why we collect it, who we give it to, and how you can access or correct it. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. What we collect

We only collect personal information that is reasonably necessary for our business. In practice that means:

We do not collect sensitive information as that term is defined in the Privacy Act 1988 (Cth), and we ask that you do not send it to us.

3. This site sets no cookies and runs no tracking

This is a set of plain HTML pages. It does not use cookies, web beacons, session storage, advertising pixels or analytics software. We do not profile visitors, we do not track you across other websites, and we do not sell or disclose personal information for advertising.

Our web host keeps standard server logs, which record IP addresses and pages requested. These are used for security and diagnostics only.

4. Who we disclose information to

We use two third-party service providers. Both are located outside Australia, which engages Australian Privacy Principle 8.

By submitting a form or placing an order you consent to this disclosure. If you would rather not have your information sent overseas, telephone us on 1300 082 011 or write to the postal address above and we will deal with your enquiry that way.

Otherwise, we disclose personal information only to our professional advisers, to a freight carrier where necessary to deliver your order, or where we are required or authorised to do so by law.

5. Direct marketing

We may use the contact details you give us to answer your enquiry and to send you information about our products. Every commercial electronic message we send will identify us and include a functional unsubscribe facility, as required by the Spam Act 2003 (Cth). You can opt out at any time by replying or by emailing info@theblackstuff.com.au, and we will action it promptly.

6. Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. The site is served over HTTPS.

We keep enquiry and order records for as long as needed for the purpose collected and to meet our legal obligations — including record-keeping obligations under taxation law — and then destroy or de-identify them.

No method of transmission over the internet is completely secure. We cannot guarantee absolute security of information sent to us.

7. Accessing and correcting your information

You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Write to the address above or email info@theblackstuff.com.au.

We will respond within a reasonable period. If we refuse access or correction we will give you written reasons, except where it would be unreasonable to do so.

8. Complaints

If you believe we have breached the Australian Privacy Principles, please tell us first. Write to the address above marked Attention: Privacy, or email us. We will acknowledge your complaint and respond within 30 days.

If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

9. Changes

We may update this policy from time to time. The current version is always the one published on this page, and it takes effect when published. The date at the top of this page shows when it was last changed.
